THE UNIFI CANADA EMPLOYEE NEW CAR GIVEAWAY – OFFICIAL RULES

THIS PROMOTION IS NOT SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH ANY AUTOMOTIVE MANUFACTURER OR AUTOMOTIVE DEALERSHIP.

This UNIFI CANADA EMPLOYEE NEW CAR GIVEAWAY (“Car Contest”) begins on December 21, 2023 and continues through March 16, 2024 (the “Promotion Period”). This Car Contest is sponsored by Unifi Aviation Canada, Inc. (“Sponsor” or “we”). By accepting a prize, each employee entrant (“Entrant”) unconditionally agrees to be bound by, and to comply with these Official Rules. All decisions of Sponsor shall be final and binding in all respects. The Promotion is open only to persons who are employed by Sponsor prior to February 3, 2024 in Canada. Sponsor reserves the right to modify the Promotion or Promotional Period, or to cancel the Promotion for any reason or no reason on a prospective basis by providing notice of such changes through the Sponsor’s website or via email communication to all employees.

Prizes: The prize consists of the award of one (1) brand-new Toyota Corolla LE or like automobile, which will be paid for by Sponsor including any purchase taxes for the Vehicle in accordance with these Official Rules. As a condition to accepting or claiming the prize, the winning Entrant (“Winner”) must have a valid and active driver’s license from a Canadian province at the time of the drawing and receipt of the vehicle. All prizes are nontransferable, non-negotiable, non-refundable and must be accepted as awarded. Sponsor reserves the right in its sole discretion to not award any prize or award a substitute prize of equal or greater value if a prize is unavailable or cannot be awarded for any reason. The actual retail value (“ARV”) of the prize represents Sponsor’s good faith determination (approximate retail value of the vehicle is $30,000 CAD). Sponsor makes no representation or warranty concerning the appearance, safety or performance of any prize awarded and all prizes are awarded by Sponsor “as is” without warranty of any kind, express or implied (except for any warranty which may be supplied by the manufacturer). Any amounts needing to be reimbursed or deducted in relation to the winning of the Car Contest, including any additional income taxes, will need to be consented to and arranged between the Winner and the Sponsor prior to acceptance of the Prize. Failure to comply with these Official Rules will result in forfeiture of the prize.

How to Enter: Those employees of Sponsor identified in internal Car Contest communications as eligible for the Car Contest who: (i) hold an active and valid provincial driver’s license (e.g., not suspended); (ii) must be an active employee of Sponsor by February 3, 2024, (iii) remains in good standing with the Sponsor which includes no letters of discipline issued during the Promotion Period and no attendance points issued under the collective agreement during the Promotion Period, (iv) is at least the age of majority at the time of entry, (v) not a legal resident of the Province of Quebec are automatically entered into the Contest during the Promotion Period (each of the foregoing, an “Entry”). Eligible employees may be eligible to receive between one and four entries into the Promotion based on the following criteria:

a) Eligible employees hired before December 21, 2023 will receive two Entries for the entire period;

b) Eligible employees hired before December 21, 2023 will receive two additional Entries if they average 32 or more hours per week during the Promotion Period;

c) Eligible employees hired between December 21, 2023 and February 3, 2024 will receive one Entry for the entire period;

d) Eligible employees hired between December 21, 2023 and February 3, 2024 will receive one additional Entry if they average 32 or more hours per week during the Promotion Period.

e) An eligible employee for each period is an employee who has completed their OJT, has an active RAID, and is performing work on the ramp as of the date listed.

Each employee who has a valid Entry agrees to provide Sponsor all information requested by Sponsor to verify such employee’s eligibility. The winner(s) of the Car Contest will be selected in a random drawing from all eligible Entries received throughout the Promotion Period conducted by Sponsor sometime after the conclusion of the applicable Promotion Period. Odds of winning vary depending on the number of eligible Entries received. Winner must correctly answer a skill-testing question without assistance of any kind and will be required to sign a release form stating that the Official Rules were read, understood, and complied with. If the drawing winner fails to correctly answer the skill-testing question, fails to execute and return the release form within the required time period, is otherwise not in compliance with the Official Rules, or is unable or unwilling to comply with these Official Rules, the drawing winner will be deemed ineligible and will forfeit his/her Prize. A new potential winner will then be selected from all remaining eligible Entries in accordance with these Official Rules. Winners will be notified in person and their email address on file with the Sponsor. Any winner notification not responded to within five (5) days may result in prize forfeiture. If any prize is forfeited, an alternate winner may be randomly selected from the remaining valid Entries in accordance with these Official Rules. The Winner must continue to be employed at the time the Vehicle is received and purchased and be in good standing (in the Sponsor’s sole discretion) in order to receive title to the Vehicle.

Additional Rules for Winner’s: Winner may only win the Car Contest once and will be disqualified from all future drawings during the Promotion Period.
For the purposes of this Car Contest, employment ends as of the date the employee receives written notice of termination or provides notice of resignation, except where any greater period is expressly required by the applicable employment, labour standards legislation, or collective agreement in which case being actively employed ceases following the minimum prescribed period under that legislation or collective agreement. For greater clarity, employment does not include any period of notice that arises upon termination of employment, whether by contract, common law or otherwise, except where the applicable employment or labour standards legislation requires otherwise.

Personal Information and Winner’s List. Any personal information supplied by the Entrants will be subject to Sponsor’s privacy policy posted at https://www.unifiservice.com/privacy-policy/ (“Privacy Policy”). By entering the Car Contest, you grant Sponsor permission to collect and retain the personal information you provide to us and to disclose and share your personal information with other third parties for the purpose of administration and prize fulfillment, including use in a publicly available winners list.

Indemnification: To the fullest extent permissible by law, each Entrant agrees to release, indemnify, and hold harmless Sponsor, its respective affiliates, subsidiaries, agents, representatives, officers, directors, shareholders, and employees from and against any injuries, losses, damages, claims, actions and liabilities of any kind and description resulting from or arising out of his or her participation in, or association with the Car Contest, including in connection with the acceptance or use of any prize. Entrant agrees that Sponsor is not responsible for, and Sponsor disclaims all liability arising from an Entrant or a Winner’s operation or use of any prize, including any claims of personal injury, property damage, or death arising from the use or operation of the prize. Each Winner, to the fullest extent permissible by law, agrees to release, indemnify, and hold harmless Sponsor, its respective affiliates, subsidiaries, agents, representatives, officers, directors, shareholders, and employees from and against any injuries, losses, damages, claims, actions and liabilities of any kind and description resulting from or arising out of his or her use or operations of any prize.

Governing Law. This Car Contest is governed by the laws of the Province of Alberta, and the laws of Canada applicable therein, without respect to its conflict of law principles. By participating in the Car Contest, Entrants agree that any and all disputes or causes of action arising out of or in connection with the Car Contest shall be settled by binding arbitration in accordance with the Arbitration Rules of the ADR Institute of Canada, Inc. The seat of arbitration will be Calgary, Alberta, and the language of the arbitration will be English. You agree to submit to the exclusive jurisdiction of arbiters in this forum and agree to waive all claims of personal or subject matter jurisdiction. However, should a grievance concerning the interpretation or alleged violation of an applicable collective agreement arise in connection with the Car Contest, the grievance procedure and arbitration provisions of the applicable collective agreement will apply.

GENERAL: Any attempted form of participation in this Car Contest other than as described herein is void. If any provision of these Official Rules or any word, phrase, clause, sentence, or other portion thereof should be held unenforceable or invalid for any reason, then that provision or portion thereof shall be modified or deleted in such manner as to render the remaining provisions of these Official Rules valid and enforceable. The invalidity or unenforceability of any provision of these Official Rules or the prize documents will not affect the validity or enforceability of any other provision. No entrant shall have the right to modify or amend these Official Rules. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision and such provision shall remain in full force and effect. All entries and/or materials submitted become the property of Sponsor and will not be returned. In the event of any conflict with any Car Contest details contained in these Official Rules and Car Contest details contained in any promotional materials (including but not limited to point of sale, television and print advertising, promotional packaging and other promotional media), the details of the Car Contest as set forth in these Official Rules shall prevail.
